Terms of Service

By accessing or using the CricCheer platform ("Platform"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations of India. If you do not agree with any of these terms, you are prohibited from using or accessing this Platform. CricCheer is operated by Buzz Near Me, a sole proprietorship registered under the laws of India ("CricCheer", "we", "us", or "our").

Minimum age: This Platform is intended for persons aged 18 years and above. By using the Platform, you confirm that you are at least 18 years old. We do not knowingly collect personal data from persons under 18. If we learn that a user is under 18, we will delete their account promptly.

CricCheer is a fan community and discovery platform. We connect cricket fans with watch parties and venues. CricCheer does not:

• Organise, manage, or operate any physical cricket watch party or event
• Control, supervise, or take responsibility for what happens at any listed event
• Verify that venues have obtained broadcast licences or public performance rights for cricket matches
• Process payments between fans and venues (hosts may link to external ticketing services)
• Guarantee the accuracy of community-sourced event listings

Hosts and venue owners are solely and exclusively responsible for the events they list, including compliance with all applicable laws, safety requirements, licensing, and third-party rights.

CricCheer is not affiliated with, endorsed by, or associated with the Board of Control for Cricket in India (BCCI), any domestic or international cricket league or franchise, Cricket South Africa, the International Cricket Council (ICC), or any cricket broadcaster including Star Sports and JioCinema/Viacom18.

All team names, tournament names, league names, broadcaster names, and related marks referenced on this Platform are the trademarks and intellectual property of their respective owners. Any reference to such names on the Platform is solely for descriptive/informational purposes (e.g., identifying which match is being watched at a venue) and does not imply any affiliation, sponsorship, or endorsement.

The CricCheer name, logo, and platform design are the intellectual property of CricCheer. Unauthorised use is prohibited.

By creating a party or event listing on CricCheer, you confirm and agree that:

• All information provided (venue, timing, amenities, pricing) is accurate and will be kept current
• You are solely responsible for obtaining all necessary licences, permits, and approvals for your event, including but not limited to: public gathering permits, food and beverage licences, fire safety compliance, and any broadcast or public performance licence required to screen cricket matches at your premises
• You will not advertise a free event and charge at the door without disclosing the cover charge on the listing
• You will maintain a safe, inclusive, and lawful environment for all attendees
• CricCheer is not liable for any injury, loss, damage, or harm arising from your event, whether to attendees, third parties, or property
• You will not use attendee data received through CricCheer for any purpose outside of managing your listed event

Broadcast rights: Publicly screening cricket matches (including domestic T20 leagues, ICC events, bilateral series) typically requires a sub-licence from the authorised broadcaster for your territory. CricCheer does not provide, broker, or guarantee such rights. You must independently verify and obtain any required broadcast licence before hosting a public screening.

By RSVPing to or attending a listed event, you acknowledge and agree that:

• CricCheer is a discovery platform only. Your attendance is a direct arrangement between you and the host/venue
• CricCheer is not responsible for the quality, safety, or conduct of any event
• You will comply with the venue's rules, the host's guidelines, and all applicable laws
• You will verify event details (time, venue, admission charges) directly with the host before attending, as listings may change
• CricCheer is not liable for any loss, injury, disappointment, or harm arising from your attendance at or journey to any event

Some party listings on the Platform are submitted by community members who are not affiliated with the venue. CricCheer does not verify the accuracy of these listings. Community-sourced listings are marked with a badge. Always confirm directly with the venue before attending a community-sourced event.

Submission limits: Each user may submit up to 5 community listings at a time. Users who have had 3 or more submissions published earn trusted status and may submit up to 10. These limits are configurable by CricCheer and may change without notice.

Content flagging: If you believe a listing is inaccurate or misleading, use the "Flag" feature on the listing. Three flags from distinct users automatically remove the listing's verified status and flag it for admin review. Abuse of the flagging system (e.g., coordinated flagging of a competitor) may result in account suspension.

Venue claims: If you are a venue owner and a community member has listed a party at your venue, you may claim ownership of the venue through the "Claim This Venue" button on the venue page. Claims are reviewed and approved or rejected by the CricCheer team. Upon approval, ownership of the venue profile and all associated party listings is transferred to your account.

You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@criccheer.com if you suspect unauthorised access.

CricCheer may award CheerCoins as a loyalty incentive. You acknowledge and agree that:

• CheerCoins have no monetary value and cannot be redeemed for cash or transferred to another account
• CheerCoins are a loyalty feature only and do not constitute a prepaid payment instrument (PPI), stored value, or e-money under RBI regulations
• CheerCoins are not purchasable with real money
• CricCheer reserves the right to modify earn/spend rates, expire unused coins, or discontinue the CheerCoins programme at any time
• All CheerCoins are forfeited upon account termination

CricCheer offers paid subscription plans for venues and fan clubs. All prices shown on the Platform are exclusive of applicable GST (18%) unless explicitly stated otherwise. GST will be added to your invoice. CricCheer will issue a GST-compliant tax invoice for every subscription payment.

Subscriptions are billed monthly, quarterly, or annually in advance depending on the plan selected, and auto-renew at the end of each billing cycle unless cancelled before the renewal date. You may cancel at any time by emailing support@criccheer.com; cancellation takes effect at the end of the current billing period. Refund eligibility varies by billing cycle — monthly plans receive no pro-rated refund, while quarterly and annual plans may be eligible for a pro-rated refund at CricCheer's discretion. Tournament Passes are refundable only as described in our Cancellation & Refund Policy, which governs all cancellation and refund matters in full.

CricCheer operates as an "intermediary" as defined under Section 2(1)(w) of the Information Technology Act, 2000 ("IT Act") with respect to user-generated content (party listings, reviews, chat messages, community submissions). CricCheer claims safe harbour protection under Section 79 of the IT Act subject to compliance with the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

If you believe any content on the Platform infringes your rights, is defamatory, obscene, or otherwise unlawful, you may submit a complaint to our Grievance Officer:

When an attendee RSVPs to your event, CricCheer may share their name and RSVP status with you for the sole purpose of managing the event. As a host, you are a data fiduciary in relation to attendee data received through the Platform. You must:

• Use attendee data only for managing the specific event for which it was shared
• Not contact attendees for marketing or other purposes without separate consent
• Delete attendee data once the event is concluded
• Comply with applicable data protection laws, including the Digital Personal Data Protection Act, 2023

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. CricCheer does not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components. CricCheer makes no representation or warranty regarding the accuracy, completeness, or reliability of any user-generated content, event listing, venue information, or community-sourced data on the Platform. CricCheer does not warrant that any venue listed on the Platform holds a valid broadcast sub-licence for screening cricket matches.

By hosts: If you list an event on CricCheer, you agree to indemnify and hold harmless CricCheer, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: (a) your event, including any injury or harm to attendees; (b) your failure to obtain required broadcast licences, permits, or approvals; (c) your misuse of attendee data received through the Platform; or (d) any breach of these Terms by you.

By all users: You agree to indemnify CricCheer from any claims arising from your violation of these Terms or applicable law.

To the maximum extent permitted by applicable law, CricCheer, its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Any injury, harm, or loss suffered at or in connection with a listed event
• Inaccurate or outdated event information
• Failure of a host to obtain required broadcast or safety licences
• Loss of profits, data, goodwill, or other intangible losses
• Unauthorised access to your account or data (beyond CricCheer's reasonable security measures)

CricCheer's total aggregate liability in connection with the Platform shall not exceed the greater of (a) the subscription fees actually paid by you to CricCheer in the 3 months preceding the event giving rise to the claim, or (b) INR 1,000 (Rupees One Thousand). For users who have not paid any fees to CricCheer, the maximum aggregate liability shall be INR 1,000.

We may suspend or terminate your account immediately, without prior notice, if you breach these Terms, violate applicable law, or engage in conduct that is harmful to other users or to CricCheer. You may delete your account at any time via account settings or by emailing support@criccheer.com. Upon account deletion, your personal data will be handled in accordance with our Privacy Policy.

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka. The parties agree to attempt in good faith to resolve disputes through mediation before initiating litigation.

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 14 days' notice via email or an in-app notification. Continued use of the Platform after the effective date of revised Terms constitutes acceptance of the changes.
